§ 1 General
Our terms and conditions apply to all the services offered on our website and are an essential part of our contracts. We are only committed to deviations if they have been agreed upon in written form.
§ 2 Offers
Our offers are subject to change.
§ 3 Reservation of proprietary rights
All goods remain our property until complete payment.
§ 4 Transportation
The dispatch is carried out at the risk and expense of the customer, if nothing else is agreed upon in written form. We are free to select the type of packaging and dispatch at our discretion.
§ 5 Delivery time
The delivery time indicated by us begins with the day of order and is kept with the date of dispatch or rather the readiness for dispatch.
§ 6 Warranty
We guarantee for a period of 24 months that the items correspond with their description and are without any errors which nullify or impair their suitability. An insignificant reduction of the usability remains out of consideration. We cannot guarantee for the content of the items, especially for the accuracy of the included texts, images, etc.
In case of defects occurring during contractual use, the customer shall give notice of such defects immediately, no later than within 7 days, in comprehensible form, specifying information useful for identification of the defect, and, upon request, in written form. The customer shall assist us, within reasonable limits, in the removal of defects.
The customer shall set an appropriate period of time for eliminating errors. Should such period expire without success, the customer may, under the legal conditions, demand a reduction of the remuneration or withdraw from the contract.
The warranty expires for those goods, which have been modified or manipulated in any way by the customer, unless the customer proves when reporting the defect that the defect did not result from any such modification or manipulation.
We can demand compensation for the time and cost invested in research for an indicated but unproven fault.
§ 7 Compensation for Damages
Compensation for damages however can only be claimed if we are culpable of intent or gross negligence. A possible compensation is limited to the price of the item.
However we cannot – to the extent permitted by law – take over liability for damages which originate directly or indirectly from the use of this website.
§ 8 Copyrights
All contents are protected under copyright. The customer acknowledges third party rights to the goods and will not use or reproduce them for commercial purposes. All kinds of usage (saving, processing, translating, etc.) or passing on to third parties is improper without our or the author’s permission.
§ 9 Payment
In the absence of any other agreement, invoices are due to be paid within 14 days. In case of a delay of payment, dunning costs and collection expenses, as well as a default interest of 1% per month, will be appropriated.
All prices include the respectively applicable statutory value added tax.
§ 10 Offset
Any offset with counterclaims against our claims is excluded, unless it has been legally determined or acknowledged by us.
§ 11 Special Provisions for Consumers
Consumers in terms of the consumer protection law are entitled to withdraw from a contract, which has been closed via distance selling within the period of time mentioned in the following paragraph. It is sufficient that the statement of rescission is sent off within the period mentioned below.
The withdrawal period is seven workdays, whereby Saturday doesn’t count as a workday. It begins upon the date of its receipt by the customer.
In the case of withdrawal, the original price will only be refunded against delivery of the resalable, originally packed goods.
§ 12 Laesio Enormis
In contrast to other legal transactions, a settlement cannot be contested for laesio enormis (avoidance of more than one half) (§ 1386 of the Austrian General Civil Law Code).
§ 13 Proper Law, Place of Jurisdiction
Austrian law applies under the exclusion of opposing law rules. The place of performance and place of jurisdiction is Vienna. If the customer is a consumer, the court responsible for the district in which the residence, the customary abode or the place of the customer’s employment is located, is responsible for any legal disputes.
